Where May I Take My ESA?

  1. Housing: As an emotional support animal (ESA) your animal is protected by the U.S. Department of Housing and Urban Development (HUD) under the Fair Housing Act (FHA) to live with you in your primary residence as your “assistance animal”, and is no longer considered a pet.  Landlords and property managers may not charge a pet fee and/or pet deposit because your animal is not a pet.  Additionally, a landlord must legally provide accommodation for your assistance animal to live with you, even if they have a “no pet” policy for the same reason – you animal is NOT a pet, but an assistance as defined by the Fair Housing Act.
  2. Airports: An emotional support animal (ESA) may fly with their handler.  With the U.S. Department of Transportation (DOT)’s ruling in 2021, airlines may recognize ESAs as “pets”, and as a result, handler’s must adhere to each airlines pet policy and procedures.  However, provided you follow their pet policies and procedures, you may still travel with your ESA, just not for free with US commercial airlines. Several international airlines continue to recognize the importance and the benefits of an emotional support animal, and as a result still accommodate emotional support animals to fly for free with their handlers.  Please check with your specific airline for further details.
  3. Public Access: Although emotional support animals don’t share the same rights and privileges as service dogs, they may still tag along with  you in public.  It is management’s discretion to allow access into their place of business so it’s important that you ask or even contact them and obtain approval before you go.  Registration and identification may often greatly increase your chances of being accommodated while out in public.  Just because you and your ESA don’t have the right, doesn’t mean you can’t.
